WV Sports Betting Law
Officially, sports betting became legal in West Virginia through The West Virginia Sports Wagering Act (S 415) on March 3, 2018. Of course, the S 415 hinged on New Jersey, and SCOTUS successfully overturning PASPA. Below here are some of the key points to WV sports betting law:
- A retail sportsbook must be located with a casino or racino.
- Online and mobile sports betting is available within state borders.
- Esports betting is available.
- Each retail location can have up to three online betting products or skins.
- Sports betting is subject to a 10% tax on adjusted gross revenue.
West Virginia finalized sports betting regulations on Apr. 9, 2019.
Sports Available
Overall, there is a wide variety of sports available for you to place wagers on in West Virginia. Notably, eSports is available in the Mountain State as well.
Finally, West Virginia is one of the more permissive states regarding player props.

Restrictions
Overall, there are very few restrictions regarding sports betting in West Virginia.
- No wagers on high school sports.
- Betting on eSports is available, but participants must be over 18 years old.
- No election betting.
While election betting is out, there was a brief amount of hours that West Virginia did offer betting markets to the 2020 election.
Geo-location
A requirement for legal sports betting in the Mountain State is being physically located within West Virginia’s state borders. In other words, you can sign-up and fund your sports betting account out of state. However, when it comes time to place a sports bet, the West Virginia online sportsbook must block any customers outside of state borders.
GeoComply, a leading geolocation gambling technology provider, essentially creates a virtual fence with state borders in mind. If your mobile device crosses over that virtual fence, you cannot place any sports wagers.
Additionally, GeoComply pinpoints your mobile device’s location through GPS with a three-point triangulation technique. Note that while mobile devices do not need to download an additional plugin, sports betting on a desktop browser may require an additional download.
Minimum Legal Age Requirement
In West Virginia, the minimum legal age requirement to sports bet online or in-person is 21 years old. Legal sportsbooks licensed by the West Virginia Lottery Commission need to verify your age and identity.
To this end, a legal and licensed sportsbook operator may ask you for a copy of your government-issued ID. Also, regardless of online or in-person sign-up for a sports betting account, you may need to provide your full Social Security number. Finally, additional documents may be required, such as utility or bank statements, to verify your address.

2020 Presidential Election Betting
On the whole, US election betting makes state legislatures gun shy. In April 2020, West Virginia was the first state to offer 2020 presidential election odds for a few minutes anyway. Therefore, literally speaking, betting on politics was available legally for a short period of time in the US, at least in West Virginia.
To begin with, WV sports betting sites, DraftKings, BetMGM, and FanDuel wanted approval to offer election markets. To this end, DraftKings and its WV partner, Hollywood Casino, emailed the West Virginia Lottery Commission regarding political prop betting.
Then, Dave Bradley, Deputy Director of Security at the West Virginia Lottery Commission, reached out to other WV sportsbooks. Every operator responded with their desired election market odds. In a short span of an hour, Bradley approved each operator.
FanDuel posted the election betting lines within a short period of a few hours after approval. Yet, lottery officials swiftly reversed course within minutes after the initial election betting lines were posted.
Finally, there were two wagers taken by FanDuel on the 2020 election betting before lines were removed. Unfortunately, with the current status of how state regulators perceive election betting, it is unlikely that legal sportsbooks will offer any markets in the near future, whether here in the Mountain State or other jurisdictions.
History of Sports Betting in West Virginia
Truly, there was a long road to the legalization of sports betting in West Virginia. The road, at times, was bumpy, with several legislative attempts failing before the current success. Read on to explore how West Virginia first established state lottery sales, which eventually paved regulation for legal sports betting.
The Basis of WV Legal Sports Betting
-
1986
West Virginia state lottery officially sells the first ticket in Jan.
-
1987
Video lottery terminals (VLTs) become available at Mountaineer Park, thanks to state legislation.
-
1994
WV Legislature allows VLTs to be available at all racetracks and bars.
-
2006
Voter referendum passes to allow a casino at the Greenbrier.
-
2007
Poker along with table games are now available at pari-mutuel racing tracks. Horse racetracks located at Charles Town and Mountaineer Park plus greyhound tracks at Wheeling Downs and Mardi Gras now become racinos (a hybrid of a racetrack and casino).
-
2010
The Casino Club at The Greenbrier officially opens for business.
Timeline of WV Sports Betting
-
2016
West Virginia Attorney General Patrick Morrisey notes that Daily Fantasy Sports betting is legal. Additionally, Morrisey filed various amicus curiae briefs in support of New Jersey overturning PASPA.
-
March 2017
Rep. Shawn Fluharty introduces H 2751, which fails. However, this pivotal bill sets up the basis of interest in legalized sports betting.
-
Jan. 2018
Fluharty tries again with another bill. Also, Sen. Stephen Baldwin files a sister bill, S 106, and both bills fail.
-
Jan. 29, 2018
Sen. Ryan Ferns introduces the West Virginia Lottery Sports Wagering Act (S 415) with the West Virginia Lottery Commission's backing.
-
Feb. 1, 2018
H 4396 is similarly presented in the House and passes through committee hearings before stalling in the House Finance Committee on Feb. 8, 2018.
-
Feb. 1-8, 2018
For the NBA and MLB, lobbyists begin passing out an outline to WV state legislatures outlining a need for a sports betting integrity fee. In particular, the leagues desire 1% of all wagers in the Mountain State paid directly to the leagues or a royalty fee.
An integrity fee appears on preliminary sports betting bills in Indiana but is not included in the final version of the bill. In WV, a sports betting integrity fee never makes it onto both bills as well.
-
March 3, 2018
While WV Gov. Jim Justice does not sign off on S 415, the bill passes through both WV Legislature chambers. Therefore, sports betting becomes legal in West Virginia, pending New Jersey’s challenge.

-
Aug. 2019
FanDuel and DraftKings launch in the Mountain State with online sports betting operational again after the exit of BetLucky.
-
Jan. 2020
DGNE, operator of Mardi Gras and Wheeling, reopen retail sportsbook operations powered this time by IGT at the racinos.
The Future of WV Sports Betting
On the whole, the future of West Virginia sports betting shows growth. For example, sports betting handle and revenue displayed an exponential percentage increase from Sept. – Dec. 2020.
Definitely, the coronavirus pandemic put a big damper on the industry. Yet, thankfully there is mobile sports betting in WV. Notably, mobile betting in WV, like in other regulated states, dominates sports betting handle and revenue.
Although West Virginia was one of the first states to legalize sports betting, the market's growth does not compare to other regulated states. Definitely, a reason for the slower growth is attributed to the BetLucky fiasco.
The West Virginia Lottery Commission is eager to avoid a repeat of that situation and thus, taking time to approve new operators. Overall, with various online sportsbooks now available in West Virginia, expect a continuation of the sports betting market's growth.
